拉各斯, 尼日利亚- Media OutReach - 2018年11月9日 - 经济和金融犯罪委员会（EFCC）已依照尼日利亚高等法院的判令，将Aiteo集团执行副主席Benedict Peters从通缉人员名单上除去。此举证实EFCC遵守了联邦首都特区高等法院O.A. Musa法官于2018年3月作出的判决。Musa法官已下令将Peters的名字从反腐败机构的网站上除去，称导致他被宣布为EFCC"通缉犯"的流程不符合宪法规定，因为该声明不是由任何已知的法律或法院判令发起或确认的。

 

尼日利亚经济和金融犯罪委员会从“通缉”名单中删除Benedict Peters的名字

针对这项指控，著名的宪法和人权首席律师Mike Ozekhome SAN表示："我们希望经济金融犯罪委员会（EFCC）在Ibrahim  Magu的领导下，履行其维护法治、服从主管法院判令的承诺，从其被通缉人员名单中除去Benedict Peters先生的名字。EFCC展示了对尼日利亚法律体系神圣不可侵犯性的极大尊重，而且我们可以证实已删除Peters的名字。有鉴于此并基于EFCC以法院判令为前提做出此决定的事实，Peters的名字已从尼日利亚通缉人员名单上合法除去。因此，Peters能够继续合法行事并享受宪法所保障的权利。"

 

EFCC于2017年3月在其网站上宣布通缉Benedict Peters。然而，针对FCT/HC/CV/23/2017诉讼，法院达成了不容置疑的论断：Peters在尼日利亚从未在任何法院因任何刑事犯罪受到指控、审讯，从未因任何犯罪行为获得保释，没有法院的任何事先判令或批准，不得受到行政命令的公开通缉。在质疑EFCC行为的诉讼中，Musa法官宣称"......依照《尼日利亚联邦共和国宪法1999年修订版》第34、37、41和46章以及《非洲人权和人民权利宪章2004年批准实施法案》第2、3（1）、3（2）、4、5、6、7和12（1）条的有关规定，这种未经主管法院任何事先判令或批准就在第一被告（EFCC）官方网站上宣告原告（Benedict Peters）为通缉人员的行径，属于非法、违法、不合法、越权、违宪行为，是对申请人个人自由、私人和家庭生活、行动自由以及不受不人道待遇和有辱人格待遇之权利等基本权利的公然侵犯"。

 

Benedict Peters曾在其他三起案例中胜诉，其中一起是推翻没收其财产的判决：错误地将他的财产纳入依照法院判令没收的某位前部长的财产清单中。
