德国莱茵布赖特巴赫 - Newsaktuell- 2020年1月13日 - Jennewein Biotechnologie GmbH于2020年1月9日向曼海姆地方法院提起了针对雀巢营养有限公司及其控股公司雀巢德国公司的专利侵权诉讼。雀巢在德国供应出售其婴儿配方奶粉Beba Supreme,该奶粉配方包含两种人乳低聚糖----仅在人乳中天然存在的独特糖。根据Jennewein Biotechnologie的调查,雀巢将人乳寡糖用于婴儿配方奶粉的生产,该配方是通过欧洲专利EP 2 896 628和EP 3 131 912(保护开始日期:2020年1月22日)的工艺(包括其他知识产权)生产的,因此雀巢的行为已构成侵权。

 

由于雀巢不仅在德国提供含有人乳低聚糖的婴幼儿食品,Jennewein目前正在对生产Illuma、SMA、NAN和Gerber Good Start等产品可能侵犯其相应外国专利开展调查。
